ARTICLE 1: SCOPE AND AMENDMENT OF TERMS OF SALE

These general terms of sale apply to all orders placed via the website www.binocle.com and through Binocle Eyewear.

Binocle Eyewear reserves the right to adapt or modify these general terms of sale at any time. In case of modification, the terms in effect at the date of the order will apply to each order.

ARTICLE 2: PRODUCT AVAILABILITY

All items are in stock unless otherwise specified on the product page.

The date of order confirmation corresponds to:

• The date of the order for payment by credit card
• The date of receipt of payment for bank transfer

In case of exceptional stock shortage for any product in your order, you will be informed immediately about the restocking delay. You may then choose a similar product at a similar price in stock, or request a refund.

ARTICLE 3: ELECTRONIC ORDER VALIDATION

Every order on www.binocle.com includes 4 steps.

1. Add products to the cart
2. Enter shipping information
3. Select the payment method
4. Receive an order confirmation

An order is considered valid once these 4 steps are properly completed.

ARTICLE 4: PRICES

Binocle Eyewear reserves the right to change prices at any time but commits to applying the rates in effect at the time of your order, subject to availability.

ARTICLE 5: PAYMENT METHODS AND SECURITY

All payments are made in Euros. VAT will be calculated automatically in the cart.

Payment Options

Payment can be made via:

• Credit Card (if available) via the CIC 3DSECURE module (Visa/Mastercard)
• Bank Transfer
• Paypal

Retention of Title

Products remain the property of Binocle Eyewear until full payment has been received.

Non-payment

Binocle Eyewear reserves the right to refuse delivery or to honor an order from a customer who has not fully or partially paid for a previous order or with whom a payment dispute is ongoing.

ARTICLE 6: DELIVERY METHODS AND TIMES

Delivery within mainland France: 2 to 3 business days

DOM-TOM & EUROPE: 7 to 21 business days

Rest of the world: 7 to 21 business days

General Information

Products are delivered to the shipping address provided during the order process.

Binocle Eyewear is not responsible for delays due to strikes, natural disasters, or other unforeseen events.

Shipping Costs

Shipping is free for orders over €50 including taxes in France, DOM/TOM, and internationally. Shipping costs remain unchanged in Europe and the rest of the world for orders over €50.

Shipping Times

All stated shipping times are calculated in business days. Each order is shipped within 24 business hours. These times correspond to processing, preparation, and shipment. Delivery time by the chosen carrier must be added.

Binocle Eyewear cannot be held responsible for delivery delays due to postal services or carriers, nor for delays beyond our control (strikes, weather conditions, high demand periods, etc.).

In case of delay, please contact our customer service to assist with tracking your delivery.

Delivery Times

The product ordered is delivered via postal service at the sole initiative of Binocle Eyewear to the address on the order form. The stated delivery times are from our warehouse.

If products need to be returned, a return request must be made to our Customer Service within 30 days of delivery. Claims after this period will not be accepted. Returns are only accepted for items in their original, unused condition (packaging, accessories, manual…).

Please check your shipping address carefully. Incorrect addresses may incur additional shipping costs.

ARTICLE 7: RESPONSIBILITIES

Law N°2004/575 of June 21, 2004 (excerpt)

The professional is fully liable towards the consumer for proper execution of obligations resulting from a distance contract, whether executed by the professional or other service providers, without prejudice to recourse rights.

However, the professional may be exempt from liability by proving that non-performance is due to the consumer, an unforeseeable and insurmountable act of a third party, or force majeure.

ARTICLE 8: RIGHT OF WITHDRAWAL

In accordance with Article L.121-21 and following of the Consumer Code, consumers have 14 business days from delivery to return items and request a refund, except for return shipping costs.

Binocle Eyewear extends this period to 30 days, and return shipping is free. Follow the return procedure. Refunds will be based on rates at the time of shipping. Contact [email protected] for any issue.

Products must be returned in good condition, with all accessories, and unused.

Where possible, return items in original packaging unopened.

ARTICLE 9: RETURN POLICY

You have 30 days from receipt of your package to return items (in part or whole), see Article 8.

Shipping costs will be deducted if, after return, the order value falls below €50. Contact [email protected] for any issue.

ARTICLE 10: WARRANTY AND CUSTOMER SERVICE

Your BINOCLE pair is guaranteed for 2 years from the purchase date against manufacturing defects.

Incorrect use or installation of third-party lenses voids the warranty. Scratches are not covered. If a defect is covered, the faulty part will be repaired or replaced.

The statutory warranty for hidden defects under articles 1641 and following of the Civil Code also applies.

ARTICLE 11: DATA PROTECTION LAW

You have the right to access, modify, correct, and delete your personal data (Article 34, French Data Protection Act of January 6, 1978).

OUT-OF-COURT SETTLEMENT - CONSUMER MEDIATION
According to Articles L 611-1 and R 612-1 and following of the Consumer Code concerning out-of-court settlement:

If the consumer has submitted a written complaint and has not received satisfaction or a response within two months, they may submit their claim for free to the consumer mediator. The mediator must be contacted within one year from the initial complaint.
